What is the DMCA?

The Digital Millennium Copyright Act (DMCA) is a United States copyright law that provides a process for copyright owners to request the removal of infringing content from online platforms. Gameplan respects intellectual property rights and complies with the DMCA. If you believe that content hosted on Gameplan infringes your copyright, you may submit a takedown request using the form below.

Requirements for a Valid Takedown Notice

To be valid under the DMCA, your takedown notice must include the following:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material that is claimed to be infringing and information reasonably sufficient to permit Gameplan to locate the material on the platform.
  • Your contact information, including your name, mailing address, telephone number, and email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the owner.

Counter-Notification Process

If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may submit a written counter-notification to Gameplan. Your counter-notification must include:

  • Your physical or electronic signature.
  • Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification of the material.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your judicial district and that you will accept service of process from the person who provided the original DMCA notification or their agent.

When required by applicable law, Gameplan may forward a valid counter-notification to the original complainant and may restore the affected content after the applicable waiting period unless the complainant tells us that court proceedings have begun.

Good Faith Requirement

The DMCA requires that all takedown notices be submitted in good faith. Filing a false or fraudulent DMCA takedown notice is a violation of federal law and may result in liability for damages, including costs and attorneys' fees incurred by the alleged infringer or by Gameplan. Before submitting a takedown request, please ensure that you are the copyright owner or are authorized to act on behalf of the copyright owner and that the use of the material is not authorized or protected by fair use or another legal doctrine.

Repeat Infringer Policy

In accordance with the DMCA, Gameplan maintains a repeat infringer policy. Gameplan may terminate, in appropriate circumstances, users who repeatedly infringe the copyrights of others. We assess notices and account history when deciding what action is appropriate.
